1. introduction
1.1 These Terms of Use (together with the documents referred to in it) (Terms of Use) apply between globalbridge Limited (company number: 08736207) whose registered office is situated at Clavering House, Clavering Place, Newcastle upon Tyne, NE1 3NG (we or us) and you, regarding the terms of use of our websites, globalbridge.org.uk, myglobalbridge.com, new.myglobalbridge.com/pro (Site), whether as a guest or as a registered user. Use of the Site includes accessing, browsing and/or registering to use the Site.
1.2 Please read these Terms of Use carefully before you start to use the Site, as these will apply to your use of the Site. We recommend that you print a copy of this for future reference.
1.3 By using the Site, you confirm that you accept these Terms of Use and that you agree to comply with them.
1.4 If you do not agree to these Terms of Use, you must not use the Site.

2.1 These Terms of Use refer to the following additional terms, which also apply to your use of the Site:
2.1.2 our Privacy Policy, which sets out the terms on which we process any personal data we collect from you, or that you provide to us; by using the Site, you consent to such processing and you warrant that all data provided by you is accurate; you can see this here
2.1.3 our Acceptable Use Policy (Acceptable Use Policy), which sets out the permitted uses and prohibited uses of the Site; you can see this here
2.1.4 our Cookies Policy, which sets out information about the cookies on the Site - you can see this here; and
2.1.5 dependent upon the type of user and the contact required there may be restrictions imposed on a user with respect to contacting other users and you are advised to consult your individual agreement with us where such, if any, may be imposed.
2.2 We recommend that you carefully read all applicable terms and policies before you start to use the Site.
3. changes to these terms
3.1 We may revise these Terms of Use at any time by amending this page.
3.2 Please check this page from time to time to take notice of any changes we may have made, as they are binding on you.
4. changes to the site
4.1 We may update the Site from time to time and may change the content at any time. However, please note that any of the content on the Site may be out of date at any given time, and we are under no obligation to update it.
4.2 We do not guarantee that the Site, or any content on it, will be free from errors or omissions.
5. accessing the site
5. 1 We will enter into separate contractual arrangements with you in respect of fees for using the Site (if any). Please note that your broadband or internet access provider as well as your mobile provider, if using a mobile device for access, may charge you for access depending on the contract you may have with your provider or providers.
5.2 We do not guarantee that the Site or any content on it will always be available or be uninterrupted. Access to the Site is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of the Site without notice. We will not be liable to you if for any reason the Site is unavailable at any time or for any period.
5.3 You are responsible for making all arrangements necessary for you to have access to the Site.
5.4 You are also responsible for ensuring that all persons who access the Site through your internet connection are aware of these Terms of Use and other applicable terms and conditions, and that they comply with them.
5.4 We reserve the right to suspend, withdraw or discontinue your access to the Site at any time and for any reason.
6. your account and password
6.1 If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.
6.2 We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms of Use.
6.3 If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at hello@myglobalbridge.com
6.4 You have the ability to copy your unique globalbridge BridgePro profile URL and share this, in addition to being able to download a .DOC version of your profile.
7. use of the site
7.1 The Site may be used by:
7.1.1 Persons being individuals of any age who may be searching for Educational Establishments that they wish to attend or for potential employment. Each Person will display a profile on the Site. A Person's profile will demonstrate their talents and achievements.
7.2.2 Educational Establishments, to promote their institution and courses to potential students.
7.2.3 Associations, set up to assist Persons with their careers and maximise their potential.
7.2.4 Employers, to showcase their organisation and display their opportunities to people who have the skills they require.
7.3 Educational Establishments, Associations and Employers may be referred to by us as "Members" and are required to enter into an individual agreement with us that further governs their use of the Site (amongst other terms). However, for the purposes of this Terms of Use, it is agreed that:
7.3.1 the Site is not a social media website;
7.3.2 registered users with profiles cannot communicate with each other through the Site nor can they see each other's profiles;
7.3.3 information a Member may seek about a person must be for its own use and relevant to the purposes set out in Clause 7.1 above. It cannot be used by a Member to seek general information;
7.3.4 no content on the Site shall be used for commercial purposes, unless we have expressly agreed that with you in advance;
7.3.5 a Member is prohibited from using any software designed to be used for purposes inconsistent with these Terms of Use; and
7.3.6 a breach of these Terms of Use may result in the termination of a Member's individual agreement with us and a referral being made to the Information Commissioner's Office.
8. intellectual property rights
8.1 We are the owner or the licensee of or have had assigned to us all intellectual property rights in the Site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. We shall only publish material on the Site where it complies with intellectual property law.
8.2 Our status (and that of any identified contributors) as the authors of content on the Site must always be acknowledged.
8.3 If you act in breach of these Terms of Use, your right to use the Site will cease immediately and you must, at our option, return or destroy any copies of materials you have made.
8.4 By providing, uploading, contributing, disseminating or otherwise making content or information available on the Site, you:
8.4.1 (to the extent permissible by law) permit us to use that content or information;
8.4.2 warrant that at the time of contributing the content or information you are the sole owner of the intellectual property rights in that content or information or have the authority of the owner to so contribute; and
8.4.3 warrant that you have the consents relevant and applicable to any third party featured or appearing (or whose trademarks and other intellectual property may appear) in that content or information and agree to indemnify us from and against any claim by a third party that results from your failure to do so.
8.5 We do not accept any liability for content or information that you choose to share through the Site, including its loss, theft or misappropriation by other users. Content or information is shared at your own risk, and you should also note that disclosure of such content may affect your ability to claim, register or assert any intellectual property rights in relation to that content or information at a later date. Should you wish to share your Site profile externally (whether on other websites such as (without limitation) Facebook or otherwise), we do not accept any liability for this and this is done at your risk (for the avoidance of doubt, you are not permitted to share anyone's profile other than your own in this way).
8.6 We will not be responsible, or liable to any third party, for the content or accuracy of any content or information posted by you or any other user of the Site. You warrant that you will ensure that all information posted by you (or, if you are school, posted by your students) onto the Site is accurate, complete and up to date and not misleading (and will be maintained this way throughout the duration of your usage of the Site). We do not accept any liability, howsoever arising, for any content or information on the Site that has not been generated and contributed by us or for any loss, direct or indirect and of whatever nature, that you may suffer as a result of that content or information.
9. no reliance on information
9.1 Although we make reasonable efforts to update the information on the Site, we make no representations, warranties or guarantees, whether express or implied that the content on the Site is accurate, complete or up-to-date.

10. limitation of our liability
10.1 Nothing in these Terms of Use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
10.2 To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to the Site or any content on it, whether express or implied.
10.3 We are not liable for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
10.3.1 use of, or inability to use, the Site; or
10.3.2 use of or reliance on any content displayed on the Site.
10.4 If you are a business user, please note that in particular, we will not be liable for:
10.4.1 loss of profits, sales, business, or revenue;
10.4.2 business interruption;
10.4.3 loss of anticipated savings;
10.4.4 loss of business opportunity, goodwill or reputation; or
10.4.5 any indirect or consequential loss or damage.
10.5 If you are a consumer user, please note that we only provide the Site for domestic, private and/or educational use. You agree not to use the Site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
10.6 We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, smart phone or other mobile device, computer programs, data or other proprietary material due to your use of the Site or to your downloading of any content on it, or on any website or other resources linked to it.
10.7 We assume no responsibility for the content of websites or other resources linked to or accessible via the Site. Such links should not be interpreted as an endorsement by us. We will not be liable for any loss or damage that may arise from your use of them.
11. Uploading content to the site
11.1 Whenever you make use of a feature that allows you to upload content to the Site, or to make contact with other users of the Site, you must comply with the content standards set out in our Acceptable Use Policy which can be seen here.
11.2 You warrant that any such contribution does comply with those standards, and you will be liable to us and indemnify us for any breach of that warranty. If you are a consumer user, this means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.
11.3 Any content you upload to the Site will be considered non-confidential. You will retain all of your ownership rights in your content. We have the right to use, copy, distribute and disclose to third parties any such content in accordance with these terms of use including any terms and conditions set out in an agreement with us and the additional terms referred to in Paragraph 2.1 above.
11.4 We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to the Site constitutes a violation of their intellectual property rights, or of their right to privacy.
11.5 We will not be responsible, or liable to any third party, for the content or accuracy of any content posted by you or any other user of the Site.
11.6 We have the right to remove any posting you make on the Site if, in our opinion, your post does not comply with the content standards set out in our Acceptable Use Policy.
11.7 The views expressed by other users on the Site do not represent our views or values.
12. viruses
12.1 We do not guarantee that the Site will be secure or free from bugs or viruses.
12.2 You are responsible for configuring your information technology, computer programmes and platform in order to access the Site. You should use your own virus protection software.
12.3 You must not misuse the Site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Site, the server on which the Site is stored, or any server, computer or database connected to the Site. You must not attack the Site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Site will cease immediately.

13.2 We have no control over the contents of those sites or resources.

14. applicable
14.1 If you are a consumer, please note that these Terms of Use (together with the documents referred to in it), their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.
14.2 If you are a business, these Terms of Use (together with the documents referred to in it), their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
